🟥 𝐐𝐮𝐞𝐬𝐭𝐢𝐨𝐧: 𝐈𝐬 𝐭𝐨𝐮𝐜𝐡𝐢𝐧𝐠 𝐚 𝐦𝐨𝐛𝐢𝐥𝐞, 𝐢𝐧 𝐚 𝐜𝐫𝐚𝐝𝐥𝐞 𝐢𝐥𝐥𝐞𝐠𝐚𝐥? 𝐓𝐰𝐨 𝐝𝐢𝐟𝐟𝐞𝐫𝐞𝐧𝐭 𝐚𝐧𝐬𝐰𝐞𝐫𝐬 𝐟𝐫𝐨𝐦 𝐓𝐟𝐋 𝐚𝐧𝐝 𝐭𝐡𝐞 𝐌𝐞𝐭 𝐏𝐨𝐥𝐢𝐜𝐞!

A Cyclist Vigilante videos a Taxi driver sitting it traffic, touching his phone with a finger. The phone itself is in a cradle on the dash, just to the side of the steering wheel.

The cyclist also videos a private hire drivers holding the phone with one hand and using the Twitter (X) app sitting at the same lights.

For clarification, the cyclist posts the video on Twitter, asking the the Met Police and TfL?
“Is using a mobile on a cradle a licence to drive without proper control ? How can you see outside the windshield while whatsapping?”.

Amazingly the Met Police answered…
”Yes it is still a offence to be using a mobile phone sitting in traffic. . Please report it online or via 101!
provide as much information as you can and this will be looked into and investigated.

This tweet from the Roads and Transport Met Police Twitter account is worrying, as it appears to contradict a post put out in the past by TfLTPH to support their special relationship with a certain online ride hailing app which said:
“The use of apps on a cradle-mounted phone is lawful if done with common sense & good judgement”.

𝐓𝐀𝐗𝐈 𝐋𝐄𝐀𝐊𝐒 𝐄𝐗𝐓𝐑𝐀 𝐁𝐈𝐓:
So there you have it….clear as mud again, with the Met and TfL both following different interpretations of the Law.

Both authorities have been asked to provide statements to clear up this issue, but neither one has replied so far.

Soon as we get an explanation from either source, we will of course update this post.
