The recent mini cab appeal against TfL's congestion charge imposition was based on a race issue and was very ill judged except for one thing, this judgement has far more of a legal framework and TFL might wrongly hope to set a legal precedent of which our trade could unduly suffer from.
Why has the brains of our trade ignored such an important argument and why have TFL been allowed to ignore one of the key 11 Characteristics "Age" as set out In the Equalities act 2010, which completely affects thousands of London Taxi Drivers without redress. This impact was even confirmed in the TFL findings of the consultation result when it was published and mentioned a clear deprivation without financial redress?
The Taxi drivers who are most likely to suffer serious losses are drivers who are over 60 and who owned their own vehicles choosing to work Less hours as the got older and paid off their taxis hence creating far less polutions.
I read a recent letter composed by Steve Mc Namara trying to address similar point but he did not once mentioning this clear breach of The Equalities act...why not?
The Equalities Act 2010 states if a clear link of deprevation based on age as indirect discrimination does when an organisation has a particular policy or way of working that applies to everyone, but affects a specific proportion far greater than the rest it is illegal.
TFL clearly states on 2.8 paragraph 5 of the consultation decision:
The LLA included a review of impacts on groups with "Protected Characteristics".
It found that 25% of taxi drivers are aged 60 or above and therefore older drivers could be disproportunatly affected by the proposals.
Why has nobody in our unions legal world picked this up?

I found a freedom of information request online from TFL going back to 20th January 2017 giving a breakdown on age of active drivers as follows:
Drivers 20-24 Years old = 45 Drivers 25-29 years old = 296
Drivers 30-34 years old = 665 Drivers 35-39 years old = 1282
Drivers 40-44 years old = 2192 Drivers 45-49 years old = 3976
Drivers 50- 54 years old = 5032 Drivers 55-59 years old = 4148
Drivers 60-64 Years old = 2863 Drivers 65-69 Years old = 2159
Drivers 70-74 Years old = 1324 Drivers 75-79 Years old = 470
Drivers 80-84 Years old = 157 Drivers 85-89 Years old = 13
Total: 24,622.
The Numbers today may have lessened since 2017, but going by the above numbers for argument sake until adjusted, the over 60-64's (2863) can just as easy be adjusted to the over 65's...which in itself is a number of 4123 drivers who simply could not sign up for a new can nor are they finding it an easy task to rent due to decommissioning, & looking at it another way, does anyone really think that if another Charecteristic highlighted under the protection of the Equalities Act 2010 was targeted in their thousands by a policy of government as a consquence of policy change ( eg: by colour, religion, sexual orientation etc) and accepted regardless of public consultation?
This Consultaion was illegally and clearly constructed to remove drivers of age too....this is apparrent.
Consultation conclusion 2.8 paragraph 5 clearly uses the term 'charecteristics' as it was constructed by a lawyer with the Equalities act 2010 in mind but NOT OBSERVED, and must be urgently investigated and stopped before 1st of November 2019becomes a red line.
Drivers of age are suffering discrimination today.
Lets get a list of those drivers together urgently with their hours and losses and put it to whoever will listen, TFL are acting Bigoted and need to be stopped now.

When i bought my cab it would have taken me over 65 to retirement,thanks to Cameron he increased my retirement age to 66,so my cab would have taken me to nearly 66,i bought the cab with the view it will see me out & then we get a Labour Mayor you know for the working man & all that,instead we get a Khunt.
I'm now faced with next March when the plate is finished well early in my opinion either finishing work 16 months early of which i don't have the money to do this-----renting a cab of which this is a cost i did not expect or need & that's if you can find one,take out a lease on a Txe which will increase my working age to 69 & all of this with Tfl looking to get older drivers off the road,they did not for one moment consider how this will affect older drivers & it puts pressure on drivers when we are considering slowing down,if the Uk does not have to be zero carbon till 2034 then why can't my cab see me out till 66,disgusted by the whole thing.
ok, guys, there is such a thing in law called Implied Contract, IT didn't have to be written into any contract you signed up to with Mand O or whatever there called now or from where ever you brought your cab from.
I was told on the three cabs that I brought over the years tx1 tx2 tx4 that the cabs were good for the 15 year age limit, You the Driver have now got a legal redress against TFL for the loss of earnings that you will have Suffered OR have Suffered.

When a 58 year old taxi driver buys the new vehicle approved by TFL euro 5 and takes a 5 year finance agreement on it, he had a deposit because his old cab still had 5 years on it, and a 5 year plan to pay the nice new can off & have some freehold if the health lasts all ok with a 62 year & 65 year medical he would then decide if another new cab was sensible or not.
The next new cab is quite a bit more expensive than the last as is the work & income far more tricky so the next commitment would not have any room for slowing down as age dictates so it is absolutely clear the older less intent cab drivers who only do mornings, afternoons or occasional days will be iliminated by rdmoving thei older cabs particularly as even the newer electric cabs age age limited thereby having zero investement values should an older driver buy one with a direct intention of selling it on coming freehold and retiring.
TFL are clearly acting as bigots treating older drivers with complete contempt and without any consideration to their lives, Id love to know how the law would have acted if tfl devised a policy which directly discriminated against thousands of tfl's own staff members who could suffer more than other staff members entirely because of their age, its utterly appalling and should be urgently looked into, I know where a bus route in north west london was in the process of a consultation over re-routing but overlooked conducting an impact study report for disabled people, the Commmissioners at tfl were contacted and suspended the changes until futher studies were investigated over a year later, we should all write to tfl or to the equalities commission because this stinks.
I'm going to write to my Mp,but as it's Dr Philip Lee i think he will send me the same response as last time when i asked about the threat to my living,,,,Fuck off basically.
I am writing via email to my London Assembly Member to Challenge the mayor, he should know only too well what discrimination is, And as a consequential means how completely misguided and wrong it is to heavilly impact particularly to disregard how it will affect older drivers as a matter of policy course.
It looks like they are trying to destroy the cab trade. Once gone, gone forever.
Well with the knowledge at an all time low I think it’s just a matter of time before it’s scrapped it’s just now worth it too much outlay and 3/4 years To pass it well if I was a knowledge of London examiner I’d be very worried about my future not sure the mayor will be wanting to pay them 50k per yer and no one to test
The penny may have finally dropped. Who in their right mind, wants to work like a dog, into old age. I think the cabbies that work past retirement age are mad. The job is finished. There won’t be any taxis left, within a few years.
