Uber have been given a two week extension to their current expired extension, as part of the 21 days to appeal process.
Yes, you read that right....as someone once said..."you couldn't make it up!"
It appears the only noises being made publicly, from our amazing saviours about this continuing saga -the one with the million pound war chest- are, "it was all our work"...
Should go down well at the next meeting of the New United Trade (NUT) group.
As most are aware, Uber were already given a four month licence extension to operate which expired at midnight earlier today.
They had four months to get their house in order, but apparently, did little to change their modus operandi.
No operator can operate without a current licence, which would makes every job dispatched to a Uber drivers illegal and therefore uninsured.
The fact that Uber have appealed.... counts for nothing as laid out in the private hire act 1998 sec 26(1), and as previously stated its illegal to operate without a licence.
So, the nice friendly people at TfL, behind close doors -presumably- and without prior announcement to the Private Hire or Taxi trade, have extended Uber's current extension by another fortnight, which flys in the face of the 1998 act?
TfL will probably continue to issue further extensions, until the legal appeal has been heard, however long that may be.
So if your licence was held up in the renewal stage, and you were told you couldn't work, it may be a good idea to seek compensation through the court as it looks like you were discriminated against. The Prime Minister herself said she wants to see a level playing field, so if it's level for Uber to carry on with unlimited numbers of temporary extensions, then surely it's leve for us to expect the same.
Even if you didn't have you're DBS certificate back to pass on, this shouldn't matter as currently Uber have 13,000 drivers with fake DBS certificates that TfL have known about since January and they have been allowed to carry on working as Minicab drivers on the Uber platform.
This appeared on the TfL website earlier.

Private Hire Vehicles (London) Act 1998, Section 26 (2)
Effect of appeal on decision appealed against.
26.—( 1) If any decision of the Secretary of State against which a right
of appeal is conferred by this Act—
(a) involves the execution of any work or the taking of any action;
(b) makes it unlawful for any person to carry on a business which he
was lawfully carrying on at the time of the decision,
the decision shall not take effect until the time for appealing has expired or
(where an appeal is brought) until the appeal is disposed of or withdrawn.
(2) This section does not apply in relation to a decision to suspend,
vary or revoke a licence if the notice of suspension, variation or
revocation directs that, in the interests of public safety, the decision is to have immediate effect.

Why is this being ignored?

Lack of openness is secrecy and to me always indicates something to hide or corruption.
Makes me angry, but not unexpected with this conservative government and their rich friends. Best not to buy any £60k vehicle as could be a bad move. We cannot exist alongside them, with their immediate hiring platform and cross border hiring they would soon be in every railway station and airport in the country, it will be the Uber transportation corporation. Believe me on that, if they continue we are finished. Very obvious as we have a vehicle more than twice as expensive to buy and run, also we have regulations to comply with and are not subsidized to offer cheap fares as they are doing with the predatory pricing. People will use the cheapest travel option, regardless on any safety or other aspects, because they will trust it won't happen to them. They also believe the computer route is best than a guy who in their terms goes the long way round. Black cabs are finished as dodgy business always thrives over those that do the right thing. You must break the rules to win, or put it another way,in life the cheats do actually prosper. Only way to fight unlawful.
I liken this to the playground bully, yes you may run and tell teacher he is doing wrong and then the teacher may well tell him he is a very naughty boy don't do it again. But the truth is the only real sure way to stop him is to do the same or more back. This is the truth, however far we think we have come we really are still slightly advanced monkeys.
When they say it's all going on in the background
It means they've gone up the pub
Sorry but TFL/politicians are literally taking the piss out of every black cab driver!Teresa May says equal level playing field within the law..well Mrs May tell that to every Surburban driver being crippled by ehailing and literally being out priced! Can TFL please explain to the 1000s of suburban drivers why it's exceptable for private hire to switch on his/her app and literally ply for hire anywhere even outside of licence areas but I as a surburban driver can only except work in my liscence area!!? Don't get me wrong the law states and is CORRECT that I should be restricted to this ruling BUT why is same ruling not applied to private hire drivers?? It's obvious that uber will be relicense but strickter practices should be in place to protect the black cab industry....Only and without exception should Green Badge taxi drivers be aloud to ply for hire in London that's the sole prvilage of those men and women sacrificing 4/5 years studying at there cost and perhaps at the expense of marriage break ups or even breakups trust me I know from experience as a failed knowledge student the hell these guys go through why is it exceptable that a person who might only of been in the country 12 months can work on ehailing/ plying for hire in the same way as a person who's studied all those years for that privilege and worst still undercutting pricing by a subserdised fair by a cash rich company who are avoiding paying proper taxes! If uber are to excist the should have offices and work should come from the office located to the work, finally if Teresa wants a equal playing field why is she discriminating towards me as a cab driver making me purchase a cab at a cost of £46,000 plus with wheelchair access? Words are cheap Mrs May, before you go to the press have your facts! Equal fair playing field I DONT THINK SO!!
The comment by the RMT about Section 26/1 of the London Private Hire Act 1998 doesnt apply because the way I read it this only applies to an appeal on a n appeal decision already made... unless I have read this incorrectlly?
26 Effect of appeal on decision appealed against.
(1)If any decision of the [F1licensing authority] against which a right of appeal is conferred by this Act—
(a)involves the execution of any work or the taking of any action;
(b)makes it unlawful for any person to carry on a business which he was lawfully carrying on at the time of the decision,
the decision shall not take effect until the time for appealing has expired or (where an appeal is brought) until the appeal is disposed of or withdrawn.
if uber are given back their license, theres only one option left bkock london with protests,we,ll have nothing to lose,it,ll only be a matter of time before we,re extinct, uber must be rubbing there hands together at the pending tube strike thursday, nice bit of surge charging for their passengers
uber aren,t fit to run a phv outfit[or is it a technology company,if so why were they granted a license in the first place] AND TFL ARE NOT FIT TO OVERSEE PASSENGER SAFETY,GET RID OF THEM AND PUT LICENSING BACK IN THE HANDS OF THE METROPOLITAN POLICE.
